Copyright Takedown Procedure
Effective 22 April 2026BISHH MALAYSIA SDN. BHD. ("BISHH") respects intellectual property rights. If you believe that content on bishhmalaysia.com — including a product listing, creator design, customer-uploaded artwork, or marketing image — infringes your copyright or other intellectual property right, you can submit a takedown notice using the procedure below.
This procedure is intended to operate in accordance with the Copyright Act 1987 (Malaysia) and applicable law, and to allow BISHH to act quickly on credible infringement reports.
1. Who can file a notice
A takedown notice can be filed by:
- the copyright or trademark owner;
- a person authorised to act on the owner's behalf (for example, an in-house legal representative, law firm, or brand-protection agency).
2. What a valid notice must include
To enable us to act on your notice, please include all of the following:
- Your identity and authority. Your full name, company (if any), contact email, contact phone, and postal address. A statement of your relationship to the work (owner / authorised representative).
- The work you claim rights in. A description of the copyrighted work or other right, including registration numbers, links to your original, or other evidence of ownership.
- The allegedly infringing content. The specific URL(s) on bishhmalaysia.com where the content appears, plus screenshots. The more precise the URL, the faster we can act.
- Why you believe it infringes. A brief explanation of how the identified content infringes the right you claim.
- Good-faith statement. A statement that you have a good-faith belief that the use of the material is not authorised by the rights owner, its agent, or the law.
- Accuracy statement.A statement, under penalty of perjury or equivalent ("I certify that the information in this notice is accurate"), that you are the owner or are authorised to act on the owner's behalf.
- Signature. A physical or electronic signature.
Incomplete notices may be returned with a request for missing information. Repeated abusive or false notices may result in rejection.
3. How to send your notice

Use the subject line "Copyright Takedown Notice" so we route it to the right team.
4. What we do when we receive a notice
Upon receipt of a valid notice, we will:
- acknowledge receipt, typically within 3 business days;
- review the notice for completeness and good-faith basis;
- disable or remove the allegedly infringing content while we investigate, where the infringement appears credible on its face;
- notify the user, customer, or creator responsible for the content and give them an opportunity to respond with a counter-notice;
- take further action — including permanent removal, account suspension, or declining to reinstate — in accordance with our investigation and applicable law.
We may also provide the user or creator with a copy of your notice so that they understand why their content is being actioned.
5. Counter-notices
If your content was removed and you believe this was a mistake or that you have the right to use the content, you may submit a counter-notice. Counter-notices should include:
- Your identity and contact details.
- Identification of the content that was removed, including the URL(s) where it previously appeared.
- A statement that you have a good-faith belief the content was removed as a result of mistake or misidentification.
- Your consent to the jurisdiction of the courts in Malaysia for any related legal proceedings.
- Your physical or electronic signature.
Send counter-notices to the same email address with the subject "Copyright Counter-Notice". We will forward a copy to the original complainant and may reinstate the content where appropriate.
6. Repeat infringers
BISHH maintains a policy of suspending and, where appropriate, terminating the accounts of repeat infringers. The Creator Agreement (see Creator Agreement) specifically permits termination for repeated or egregious infringement.
7. False notices
Filing a false, bad-faith, or knowingly misleading takedown notice may expose the sender to liability, including for damages caused by the wrongful removal. If you are unsure whether content infringes your rights, we recommend consulting a Malaysian intellectual property lawyer before filing.
8. Trademark and other IP claims
Although this Procedure is titled "Copyright Takedown", the same process can be used for trademark, design right, passing off, or other intellectual property claims. Please describe your right accurately in the notice so we can evaluate it appropriately.
