Creator Agreement

This Creator Agreement (the "Agreement") governs your participation in the BISHH Creator Platform operated by BISHH MALAYSIA SDN. BHD. ("BISHH", "we", "us"). It applies in addition to the Terms of Sale & Website Use, the Artwork & IP Policy, and the Privacy Notice.

By applying to become a Creator or by publishing any design on the BISHH platform, you agree to this Agreement.

1. Who can become a creator

Creators must be at least 18 years old (or, if a business, validly registered) and able to enter into binding contracts under Malaysian law. Approval is at our discretion — we may accept, reject, or revoke Creator status without being required to give reasons.

2. How the platform works

Creators upload design artwork which is applied to BISHH's blank products (tees, hoodies, totes, etc.) and sold through the BISHH storefront. Each sale is a transaction between the customer and BISHH MALAYSIA SDN. BHD. — BISHH handles printing, fulfilment, shipping, customer service, payment, tax, and refunds. Creators are not the seller of record.

3. Intellectual property in creator designs

Ownership. You retain ownership of the copyright and other intellectual property rights in the original artwork you upload, subject to the warranties below.

Licence to BISHH. By uploading a design to the platform, you grant BISHH a worldwide, non-exclusive, royalty-free, sub-licensable licence for the period the design is published (and a reasonable wind-down period after removal) to:

• store, reproduce, resize, colour-adjust, and prepare the design for print production;
• apply the design to BISHH blank products and sell the resulting goods;
• display the design in storefront product listings, creator profile pages, search, recommendations, and marketing (website, email, social media, marketplace listings); and
• fulfil, reprint, handle disputes, and keep operational records for sold orders.

This licence is the minimum needed to operate the platform. It does not transfer ownership of your artwork to BISHH.

4. Creator warranties

For every design you upload, you represent and warrant that:

• You are the sole owner of the design, or you hold all necessary rights, licences, and permissions to publish and monetise it through BISHH.
• The design does not infringe any third-party copyright, trademark, design right, patent, trade secret, privacy, publicity, or moral right.
• The design does not contain content prohibited under our Artwork & IP Policy §2.
• The design is your original work, or is used under a licence compatible with commercial resale.

5. Creator indemnity

You agree to indemnify, defend, and hold harmless BISHH MALAYSIA SDN. BHD., its directors, officers, employees, agents, affiliates, and customers against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with any design you upload or any breach of your warranties in §4 above.

6. Revenue share and payouts

Revenue share. You earn a fixed percentage of the net sale price of each sold item that features your design, as configured in your Creator dashboard. (Commercial share terms are subject to a separate schedule and may be updated on written notice.)

Calculation. Net sale price = customer-paid product price minus the base product cost (the BISHH blank), minus payment gateway fees, minus any applicable tax. Shipping fees are excluded from revenue share calculations.

Reconciliation window.Earnings become reconciled once the order is fulfilled and the customer's claim window (7 days from delivery) has passed without a valid claim. Chargebacks, refunds, or approved returns reverse the associated earnings.

Payouts. Payouts are issued monthly in arrears via bank transfer or approved Malaysian e-wallet to the account on file, subject to a minimum payout threshold. Below the threshold, earnings roll into the next month.

Tax. Creators are responsible for their own income tax, SST, or other tax reporting on earnings received. BISHH may be required to withhold tax where applicable under Malaysian law.

7. Content rules

Designs uploaded to BISHH must not:

• reproduce or closely imitate third-party brands, logos, athletes, celebrities, or licensed characters without documented permission;
• contain hate speech, slurs, or content targeting protected groups;
• contain explicit, obscene, or sexualised content;
• glorify violence, self-harm, or illegal activity;
• promote regulated goods (firearms, drugs, gambling) in a manner inconsistent with Malaysian law;
• breach any other provision of our Artwork & IP Policy.

BISHH may remove any design that we reasonably believe breaches these rules, with or without prior notice, and may terminate repeat offenders.

8. Quality and production control

BISHH handles print production, QA, packing, and dispatch using our standard processes. Production decisions (including substrate, ink, print method, and minor positional adjustments) are at our discretion to ensure product quality and printability. Significant changes to your design are made only with your consent.

9. Creator dashboard and data

Creators have access to a dashboard showing sales, earnings, reconciliation status, and payouts. We provide reasonable tools to help you manage your designs and storefront presence. Abuse of the dashboard (scraping, bulk automated uploads, impersonation) may result in suspension.

Creator personal data is processed under our Privacy Notice.

10. Exclusivity and off-platform sales

Unless expressly agreed in writing, creator participation on BISHH is non-exclusive — you remain free to sell the same or different designs through other channels.

11. Removal and termination

Either party may terminate this Agreement at any time, with or without cause, by written notice through the Creator dashboard or email. On termination:

• your designs will be unpublished from new listings;
• we may continue to fulfil pending orders already paid for;
• outstanding earnings will be paid out in the next scheduled payout cycle, subject to the minimum payout threshold;
• the licence granted to BISHH in §3 continues solely to the extent needed to fulfil pending orders, honour reprints, and keep operational records.

We may also suspend a Creator account immediately for a breach of warranties, a credible infringement claim, fraud, chargeback abuse, or content-rule violations.

12. Platform changes

We may change platform features, fee structures, and the revenue share schedule from time to time. Changes to commercial terms affecting Creator earnings will be notified in advance, and will not retroactively reduce earnings already accrued on completed, reconciled orders.

13. Liability

BISHH's aggregate liability to a Creator under this Agreement in any 12-month period shall not exceed the total earnings paid to that Creator in the preceding 12 months, except to the extent such limitation is prohibited by Malaysian law.

14. Governing law

This Agreement is governed by the laws of Malaysia. Disputes not resolved amicably are subject to the appropriate forum or court in Malaysia.
