These Terms of Sale and Website Use apply to the website presently operated under bishhmalaysia.com and to orders placed with BISHH MALAYSIA SDN. BHD. (trading as BISHH) for custom apparel, printed garments, accessories, and related services.

2. Acceptance of terms

By accessing the website, submitting artwork, placing an order, or making payment, the customer agrees to be bound by these Terms, the Artwork and Intellectual Property Policy, the Shipping-Returns-Reprint Policy, and the Privacy Notice.

3. Eligibility and accuracy of information

The customer must provide true, accurate, current, and complete information when creating an account, placing an order, uploading artwork, or communicating delivery details. BISHH may refuse or suspend orders where information appears incomplete, misleading, or suspicious.

4. Product information and website disclosures

BISHH aims to present accurate descriptions of product characteristics, garment options, print types, price components, payment methods, sale terms, and estimated production/delivery timelines. However, colours and visual appearance may vary due to screens, lighting, fabric texture, and production tolerances.

For Malaysian online marketplace compliance, mandatory disclosures will be made available in Bahasa Melayu, with English provided in addition where desired.

5. Orders, acknowledgement and acceptance

A submitted order is a request to purchase and is not deemed accepted until BISHH confirms that the order can be processed. An automated acknowledgement of receipt may be issued after submission or payment, but final acceptance may still be subject to stock availability, artwork suitability, verification, and internal review.

BISHH may reject or cancel an order before production if there is a pricing error, suspected fraud, suspected infringement, prohibited content, stock issue, courier restriction, or other reasonable operational or legal concern.

6. Prices and payment

Prices are shown in Ringgit Malaysia (MYR) unless clearly stated otherwise. The full payable amount is disclosed before checkout confirmation, including transportation charges, taxes where applicable, rush surcharges, add-on service fees, and any other payable cost.

Payment must be successfully received before production begins unless BISHH expressly agrees otherwise in writing. Payment is processed securely through licensed Malaysian payment gateways (currently iPay88). Accepted methods include FPX online banking, credit/debit card, and supported e-wallets as listed at checkout.

7. Order review and error rectification

Before payment or final confirmation, the website provides the customer with a meaningful opportunity to review and correct errors relating to garment type, colour, size, quantity, design placement, spelling, shipping information, and other order details.

Even after submission, BISHH may, at its discretion, assist with rectification where production has not yet started. Once production has started, changes may not be possible.

8. Customer approval of artwork and order details

Where a preview, mockup, proof, order summary, or approval link is shown to the customer, the customer is responsible for carefully checking all visible details before approving or confirming production, including spelling, grammar, artwork content, print side, dimensions, garment type, colour, size, and quantity.

BISHH shall not be responsible for errors that were visible or reasonably reviewable at the time of approval or confirmation.

9. Custom-made goods; changes and cancellation

Because the products are made to customer specification or clearly personalised, orders may only be changed or cancelled before production starts and only if BISHH expressly agrees. Cancellation requests must be received within 4 hours of payment and before artwork has been approved for production.

Once artwork has been approved or production, sourcing, printing, packing, or dispatch preparation has started, the order may no longer be cancelled, changed, returned, or refunded except where required by applicable law or where the item is defective, materially different from the order, or contains a production error directly caused by BISHH.

10. Production and delivery timing

Any production timeline, dispatch timeline, or delivery estimate shown on the website, invoice, quotation, chat, or order acknowledgement is an estimate only unless BISHH expressly guarantees it in writing. Reasonable delays may occur due to artwork clarification, stock shortage, machine issues, courier congestion, force majeure, public holidays, customs, or other factors beyond reasonable control.

11. Acceptable use of website

The website must not be used for unlawful activity, unauthorised access, malware transmission, scraping that impairs service, abusive conduct, fraudulent chargebacks, or misuse of upload tools. BISHH may suspend access or cancel impacted orders where necessary to protect the business, customers, or third parties.

12. Intellectual property in website content

Unless otherwise stated, website content created by BISHH, including text, photos, graphics, layout, pricing structure, and branding, remains the property of BISHH or its licensors. No website content may be reproduced, copied, or commercially exploited without permission, except for ordinary browsing and purchasing use.

13. Limitation of liability

Nothing in these Terms excludes, restricts, or limits any right or remedy that cannot lawfully be excluded or restricted under Malaysian law.

Subject to the above, BISHH's aggregate liability arising out of or in connection with an order shall not exceed the amount paid for the affected order. BISHH shall not be liable for indirect, incidental, special, or consequential loss such as loss of profit, loss of business, or loss of opportunity, except to the extent such limitation is prohibited by law.

14. Governing law and disputes

These Terms are governed by the laws of Malaysia. Any dispute that cannot be resolved amicably shall be subject to the appropriate forum or court in Malaysia, without prejudice to any consumer rights or statutory avenues that may apply (including under the Consumer Protection Act 1999 and the Consumer Protection (Electronic Trade Transaction) Regulations 2024).

15. Changes to terms

BISHH may update these Terms from time to time. Updated versions are published on the website with a revised effective date. Orders already accepted shall generally continue to be governed by the version in force at the time of order, unless the change is required by law or expressly agreed otherwise.
